RatePath is not a lender and does not guarantee approval, rates, savings, or loan terms. Section 11 contains a binding individual arbitration agreement and class-action waiver, including instructions for opting out.
1. Acceptance and eligibility
By accessing RatePathLoans.com or submitting information through the Site, you agree to these Terms of Use and acknowledge the Privacy Policy. If you do not agree, do not use the Site.
You must be at least 18 years old, legally able to enter into an agreement, and a resident of the United States to use the Site. You may use the Site only for yourself or for another person who has expressly authorized you to act on their behalf.
2. Our service and role
RatePathLoans.com provides marketing, lead-generation, and referral services for companies involved in mortgage refinance and related financial services. RatePath is not a lender, creditor, loan servicer, financial adviser, or real-estate broker. RatePath does not make credit decisions, underwrite or fund loans, set rates or fees, issue commitments, or guarantee that a provider will accept your request.
Submitting a form is a request to be matched or contacted; it is not a loan application, prequalification, preapproval, commitment, or offer. Any product, rate, payment, savings estimate, annual percentage rate, fee, or term is determined solely by a participating provider after its review. Illustrations on the Site are examples only and may not be available to you.
You are not charged by RatePath for using the Site. RatePath may receive compensation from providers for marketing services, referrals, contacts, or resulting transactions.
3. Your information and responsibilities
You agree to provide current, complete, and accurate information and to correct it if it changes. You represent that any telephone number, email address, property information, and other data you submit belongs to you or that you are authorized to provide it. You may not impersonate another person, submit fabricated information, or use the Site for unlawful, fraudulent, or abusive purposes.
You are responsible for evaluating any provider and offer, reviewing all disclosures and final documents, and obtaining independent financial, tax, legal, or other professional advice when appropriate.
4. Consent to be contacted
When you click “View My Savings” or otherwise submit a request, you electronically sign and authorize RatePath to disclose your information to up to six participating partners. You provide prior express written consent for RatePath and those partners to contact you at the telephone number and email address you provided regarding mortgage, refinance, or related products and services.
Contact may include calls, emails, SMS, and MMS and may use an automatic telephone dialing system, prerecorded or artificial voice, or artificial-intelligence technology, even if your number appears on a state, federal, or corporate Do Not Call list. Message and data rates may apply. Message frequency varies.
Your consent is not a condition of obtaining goods or services. You may use the Site without consenting to marketing contact by emailing consent@ratepathloans.com. You may revoke consent at any time by replying STOP where available, telling the caller, using another opt-out method provided in a communication, or emailing us. Revocation does not affect communications already lawfully made.
5. Electronic signatures, records, and disclosures
You consent to use electronic signatures and to receive records, notices, and disclosures related to your Site request electronically. Your electronic action has the same effect as a handwritten signature to the extent permitted by law.
To access and retain electronic records, you need an internet-connected device, a current web browser, an active email account, and sufficient storage or printing capability. You may print or save these Terms and the Privacy Policy. To update your email address, withdraw consent to electronic records, or request a paper copy, email consent@ratepathloans.com. Withdrawal applies prospectively and may limit our ability to provide an online service, but it does not affect the validity of prior electronic records or signatures.
6. Acceptable use
You may not:
- Use the Site in violation of law or another person’s rights.
- Submit false, misleading, unauthorized, or malicious information.
- Attempt to gain unauthorized access to the Site, data, accounts, systems, or networks.
- Interfere with Site operation, introduce malware, overload infrastructure, scrape or harvest data, or bypass security or access controls.
- Copy, modify, distribute, sell, lease, reverse engineer, or commercially exploit the Site except as expressly permitted by law or in writing.
We may suspend or terminate access, block submissions, or take other reasonable action if we believe these Terms have been violated or the Site is being misused.
7. Participating providers and third-party services
Participating providers are independent third parties, not RatePath’s agents. RatePath does not control and is not responsible for their eligibility standards, communications, conduct, products, rates, fees, terms, privacy practices, or decisions. Your dealings with a provider are solely between you and that provider.
The Site may link to or use third-party websites and services, including address-completion, hosting, analytics, communications, and licensing-information services. Links are provided for convenience and do not imply endorsement. Third-party terms and privacy policies apply to their services.
8. Intellectual property
The Site, including its design, text, graphics, software, selection, arrangement, and branding, is owned by or licensed to RatePath and protected by applicable intellectual-property laws. Subject to these Terms, RatePath grants you a limited, revocable, nonexclusive, nontransferable license to use the Site for your personal, noncommercial purpose.
9. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” RATEPATH DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
RatePath does not warrant that the Site will be uninterrupted, error-free, secure, or free from harmful components, or that information, estimates, matching, providers, or offers will be complete, current, or suitable for you. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
10. Limitation of liability and indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RATEPATH AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR LOSS ARISING FROM YOUR USE OF THE SITE, A PROVIDER’S ACTS OR OMISSIONS, OR ANY PRODUCT OR SERVICE.
To the maximum extent permitted by law, RatePath’s aggregate liability arising from the Site or these Terms will not exceed $100. These limitations do not exclude liability that cannot legally be limited or excluded.
You agree to defend, indemnify, and hold RatePath and its affiliates, owners, officers, employees, and agents harmless from claims, liabilities, damages, judgments, losses, and expenses arising from your unlawful misuse of the Site, your material violation of these Terms, or information you submit without authorization.
11. Binding arbitration and class-action waiver
Please read this section carefully. It affects your right to go to court and have a jury decide a dispute.
Informal resolution first
Before starting arbitration, you and RatePath agree to try in good faith to resolve a dispute for at least 30 days. Send a written description of the dispute, the relief requested, and your contact information to consent@ratepathloans.com with the subject “Notice of Dispute.” Any limitations period will be tolled during this 30-day period to the extent permitted by law.
Individual arbitration
Except for the exceptions below, any dispute, claim, or controversy arising out of or relating to the Site, these Terms, the Privacy Policy, or communications associated with your request will be resolved by binding arbitration on an individual basis. The Federal Arbitration Act governs the interpretation and enforcement of this section.
Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, available at adr.org. The arbitrator may award the same individualized remedies available in court. RatePath will pay arbitration fees it is required to pay under the AAA rules or applicable law. A hearing may take place by telephone, videoconference, written submission, or at a reasonably convenient location.
Exceptions
Either party may bring an individual action in small-claims court if it qualifies. Either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual-property rights, confidential information, or system security while arbitration is pending.
No class or representative proceedings
YOU AND RATEPATH AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE ACTION. UNLESS BOTH PARTIES AGREE, THE ARBITRATOR MAY NOT COMBINE CLAIMS OR PRESIDE OVER A REPRESENTATIVE PROCEEDING.
Opting out
You may opt out of this arbitration agreement by emailing consent@ratepathloans.com within 30 days after first accepting these Terms. Use the subject “Arbitration Opt Out” and include your full name, telephone number, email address, and a clear statement that you are opting out. Opting out will not affect other provisions of these Terms.
If part of this arbitration section is found unenforceable, the remainder will remain in effect, except that if the class-action waiver is found unenforceable as to a particular claim, that claim must proceed in court and not arbitration.
12. General terms
These Terms and the Privacy Policy are the entire agreement between you and RatePath concerning the Site, except for any separate written agreement that expressly applies. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.
RatePath’s failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a business transaction or by operation of law. Headings are for convenience only.
We may update these Terms by posting a revised version and changing the effective date. Changes apply prospectively. Your continued use after the effective date constitutes acceptance to the extent permitted by law.
